Who we are

This website, makglobal.africa, is run by Makhathini Global (Pty) Ltd, trading as MAKGLOBAL, a private company registered in South Africa and based in Cape Town. In these terms, “we”, “us” and “our” mean MAKGLOBAL, and “you” means anyone who uses the site.

We design, build and hand over AI agents and automation for businesses, mainly South African financial services firms.

Using this site

By using this site, booking a call, completing a form or signing up for our newsletter, you agree to these terms. If you do not agree, please do not use the site.

If you use the site on behalf of a business, you confirm that you may act for that business.

Information, not advice

Everything on this site is general information about our services. It is not financial, investment, legal, tax or compliance advice, and you should not rely on it as such.

MAKGLOBAL is not an authorised financial services provider under the Financial Advisory and Intermediary Services Act, and we do not give financial advice or render intermediary services. Where our work touches your regulatory duties (for example FAIS, FICA or POPIA), you and your own compliance officer remain responsible for meeting them.

We try to keep the site accurate and up to date, but we do not guarantee that it is complete, current or free of errors.

The free hours promotion

We work in three phases. Phase 0 is discovery: we learn how your firm works and what is getting in the way. As a promotion, we may provide up to 10 hours of Phase 0 at no charge. The promotion is subject to these conditions:

  • there is no obligation to buy anything afterwards, and no invoice for the free hours;
  • it is offered at our discretion, mainly to businesses we believe we can help, and we may decline a request without giving reasons;
  • availability is limited and places are given in the order we can schedule them;
  • it is limited to one promotion per business, unless we agree otherwise in writing;
  • the free hours have no cash value and cannot be exchanged or transferred;
  • we may change or withdraw the promotion at any time. Hours already scheduled with you will be honoured unless we agree otherwise.

Bookings and the confidential log

When you book a call or complete the confidential log, please give accurate, complete and current information, and only information you are entitled to share. Describe the work, not the people: do not include client names, ID numbers or other personal information of your clients.

A booking is a request. We may decline or reschedule a booking, and we will let you know if we do. Submitting a form does not create a contract for paid services.

Quotes, proposals and prices

Any quote or proposal we send is valid only for the period stated on it. Paid work is governed by a separate written agreement signed by both parties. If that agreement conflicts with these terms, the signed agreement prevails.

Packages, prices and timelines shown on this site are indicative. They exclude VAT unless stated otherwise, depend on the scope we agree with you, and may change without notice. A price on the site is not an offer that you can accept; the price you pay is the one in your signed agreement.

Estimates, sample outputs and demos

Our cost and payback calculators give illustrative estimates only, based on the figures you enter and on assumptions we state. Your actual costs, savings and results will differ.

Sample outputs, such as the sample record of advice, are made-up examples to show what an agent can produce. They are not advice and do not describe a real client.

Demo pages under /demos are illustrative mock-ups, built from publicly available information to show what a website or tool for a business could look like. They are not that business’s official website, they are not endorsed by it, and they are not indexed by search engines. If a demo was made for your business and you would like it removed, email us and we will take it down.

Intellectual property

The content of this site, including its text, design, videos, graphics, code and the MAKGLOBAL name and logo, belongs to us or our licensors. You may view it and print or save pages for your own reference in considering our services. You may not copy, republish, sell or adapt it for other purposes without our written permission.

Ownership of work we build for clients is set out in the signed agreement for that work.

Acceptable use

You agree not to:

  • use the site for anything unlawful, fraudulent or harmful;
  • submit false information, or information about another person without their permission;
  • try to gain unauthorised access to the site, its forms, admin pages or the systems behind them, or interfere with how they work;
  • send malicious code, spam or automated bulk submissions through our forms;
  • scrape or copy the site in bulk.

We may block access to the site, or ignore submissions, where we reasonably believe these terms have been broken.

Limitation of liability

To the extent permitted by law, including the Consumer Protection Act where it applies, the site is provided “as is”, and we are not liable for any loss or damage, whether direct, indirect or consequential, that arises from using or relying on the site, its information, calculators, sample outputs or demos, or from the site being unavailable.

Nothing in these terms limits any right you have that cannot be limited by law, or our liability for gross negligence or wilful misconduct. Liability for paid work is governed by the signed agreement for that work.

Privacy

How we collect and use personal information, including what you give us through our forms and the confidential log, is explained in our privacy notice, which follows the Protection of Personal Information Act (POPIA).

Governing law

These terms are governed by the law of the Republic of South Africa. You agree that the courts of the Western Cape have jurisdiction over any dispute about them, without limiting any right you may have to approach a tribunal or forum under consumer protection law.

If any part of these terms is found unenforceable, the rest remains in force.

Changes to these terms

We may update these terms from time to time. When we do, we will change this page and the date at the top. The version on this page when you use the site is the one that applies.
